North Korea hails nuclear, military feats of Kim Jong-il (Reuters)

SEOUL (Reuters) ? North Korea lauded the military might built up by deceased leader Kim Jong-il on Thursday, likely tying his young successor to the same policies that have set Northeast Asia on edge as the impoverished state inches closer to nuclear weapons capability.

A gathering of 100,000, soldiers in uniform and bare-headed civilians, gathered in silence in wintry sunlight in the capital Pyongyang to mourn the passing of the man who had led the country for 17 years until his death on December 17.

Kim Jong-un, a jowly man in his late 20s who will become the third of his line to lead North Korea, took centre stage overlooking the central square named after his grandfather to listen to tributes to the "great revolutionary."

"Great Leader Kim Jong-il ... laid the foundation for our people to live on as autonomous people of a world-class military power and a proud nuclear state," parliament chief Kim Yong-nam said in the eulogy.

The North has conducted two nuclear tests.

Larry Niksch, who has tracked North Korea for the non-partisan U.S. Congressional Research Service for 43 years, believes it could take as little as one to two years to have a working nuclear missile once it produced enough highly-enriched uranium for the warhead's core fuel.

That could threaten regional security and give the North a powerful bargaining tool in extracting aid for its economy.

North Korea's state television footage showed the young Kim flanked to his right by the country's top military general Ri Yong-ho on the balcony of the Granc People's Study House. Also nearby him were Defense Minister Kim Yong-chun, and his uncle and the key power-broker in the transition, Jang Song-thaek.

Jang, 65, is believed to be the regent heading a select group of caretakers, as the brother-in-law of Kim Jong-il who survived purges to become his closest confidant who oversaw the power succession before his death of a heart attack.

He stood behind the younger Kim in Wednesday's mass funeral parade, escorting the hearse carrying the coffin.

Solemn and grimacing, the younger Kim, believed to be born in early 1984, stood motionless throughout the ceremony. He only came to the forefront of the North's dynastic succession last year by taking on key military and ruling party posts.

"Comrade Kim Jong-un is the highest leader of the party and people who takes on Great Leader Kim Jong-il's philosophy and leadership, personality and morals, courage and audacity," Kim Yong-nam said.

CRUEL AND CUNNING ENOUGH TO SUCCEED?

Mourners, their heads bowed as the ceremony concluded, spilled over to both sides of the Taedong River as temperatures stood at about minus 10 Celsius (14 Fahrenheit). Boats moored on the river and trains in their yards blew their whistles for three minutes to mourn Kim Jong-il's passing.

The eulogies were short on boasts about economic achievements from a strongman who used his Songun, or "military first," policy to divert resources to build a conventional and weapons of mass destruction program.

The North's economic output is now smaller than in the 1990s under the rule of his father Kim Il-sung, who founded the state in 1948, and it has been squeezed harder under international sanctions for its missile and nuclear tests.

Gyorgy Toloraya, a Russian expert who is Director of Korean Programs at the Institute of Economy at the Russian Academy of Sciences, who met Kim Jong-il for the first time in 2000 described him as "fast and witty and having "a remarkable memory" on any subject.

"...one exclusion might be modern economics, in which he, it seemed, was not so very interested, regarding it just as a tool for rich Westerners to extract profits from their fellow compatriots and poor countries," Tolaraya wrote on 38North, a website published by the U.S.-Korea Institute at Johns Hopkins School of Advanced International Studies.

Most Korea-watchers do not expect the North to stage a repeat of the attacks it undertook in 2010 when it killed South Korean civilians with an artillery barrage and, according to most observers, sank a South Korean naval vessel. It denied sinking the vessel and says it was provoked into the barrage.

It may take Kim Jong-un some months to assume the full panoply of official titles held by his father.

"The real question is whether the new Kim has the cruelty and cunning, qualities that his father and grandfather Kim Il-sung possessed in plenty, to preserve in the long run the essential engine of the destitute dynasty he inherits," wrote Sung-Yoon Lee of Tufts University, a leading North Korea watcher.

Military / Holiday Bowl GameThread, 1.30p / 5p

First up on this bowl Wednesday doubleheader is the Northrop-Grumman-sponsored Military Bowl, starring Air Force (which makes sense) and...Toledo (which I suppose makes sense because they're Rockets). I should warn you that rooting for Toledo means you are anti-American.

Next up is the Bridgepoint Education Holiday Bowl, featuring Cal and Texas, two schools associated with prominent athletes who leave school early (like Vince Young and geometry whiz Jason Kidd). A commitment to education, indeed. Perhaps in "Bridgepoint Education Holiday Bowl," "Education" is modifying "Holiday"? Yeah, that would make more sense.

American Cancer Society Study Finds Colorectal Cancer Mortality ...

(3BL Media / theCSRfeed)?Atlanta, GA ? December 28, 2011 ? A new study finds that while colorectal cancer mortality rates dropped in the most recent two decades for every stage in both African Americans and whites, the decreases were smaller for African Americans, particularly for distant stage disease. The authors say concerted efforts to prevent or detect colorectal cancer at earlier stages in blacks could improve worsening black-white disparities.

Before 1980, colorectal cancer mortality rates for African Americans were lower than those for whites. Since then, however, the pattern of CRC mortality rates has reversed and diverged, so that in 2007, the rate for African Americans was 44 percent higher than for whites. This worsening disparity in mortality rates coincided with the introduction and dissemination of screening and improved treatment for colorectal cancer.
?
Studies show dissemination of screening and improved treatment for colorectal cancer among African Americans has lagged behind whites. However, the extent to which black-white disparities in mortality rates vary by stage at diagnosis is unknown. To find out, American Cancer Society researchers led by Anthony S. Robbins, M.D., Ph.D., examined disparities in stage-specific colorectal cancer mortality rates using the Incidence-Based Mortality database of the National Cancer Institute?s Surveillance, Epidemiology, and End Results (SEER) Program.
?
They found for localized stage, mortality rates decreased 30.3 percent in whites versus 13.2 percent in African Americans. For regional stage disease, those declines were 48.5 percent versus 34.0 percent, respectively. For distant stage, the decreases were 32.6 percent versus just 4.6 percent.
?
The data indicates that black-white disparities in colorectal cancer mortality increased for each stage of the disease, and that the overall disparity in overall mortality was largely driven by trends for late stage disease. ?The widening racial disparity for distant stage has a disproportionate impact on overall CRC mortality disparities because distant stage accounts for approximately 60% of the overall black-white mortality disparity,? write the authors.
?
As to why, the authors cite differences in early detection and differences in treatment. African Americans have historically been less likely than whites to be screened for colorectal cancer. In addition, African Americans who are screened often lack timely follow-up. Meanwhile, studies show the dissemination of improvements in treatment has been uneven. Despite its known survival benefit, adjuvant chemotherapy treatment rates among African American patients with colorectal cancer are disproportionately low relative to whites.

Google Vs. Apple: Google Android Tablet Rumors

Posted by Geronimo Boosh on December 26, 2011 ? Leave a Comment?

Google says they will have a tablet for release in about six months. It is supposed to be of the ?highest quality?, so it can be assumed that Google wants to challenge Apple on their own turf. Read more on the upcoming Google tablet here in this quick article.

The Google chairman has released a statement that will not be putting a scare into the heart of anyone at Apple anytime soon. Google is planning on creating a tablet. Now that they have consolidated their Android mobile operating system into the Ice Cream Tablet version, their horizons have widened. The comparisons with an Apple iPad are unavoidable, since these two companies are arch enemies.

Some have seen the Google tablet and even say there is more than one model. It is assumed that it will bear the same ?Nexus? name as the Google handsets. The New York Times has apparently seen it or have some insider information on the tablet. They say it is designed as an ereader that also functions as a computer. It is not going to be like the failed Chrome tablet ( called the ?Chromebook? ) of yore. It will bear the Android operating system but have the Chrome browser that Google also created. The tendency to get everything done ?in house? is still not going to be as good as Apple, but it is a one-time shot at greatness.

Some say the upcoming Google tablet is the only one that can give Apple a run for their money. It is going to have books and magazines, like the ?iBooks? app for iPad and iPhone. It is assumed that the Google Nexus tablet will have a camera, which the iPad 2 does not have. The iPad 3 is right around the corner and is expected to have a camera included with it. The really big change that is coming up for the iPad 3 is the display. It is going to have a ?retina? display, just like the iPhone 4 and 4S. This is going to be a ?game changer? for the tablet industry and Google most likely is not going to be able to keep up. The iPad 3 is going to have a 2048 by 1536 pixel resolution. Since screens are the number one most important part of a touch screen tablet, Google had better have something special to offer.

The Google Android tablet is going to need to look like a million dollars if they are going to ask a lot of money for it. The iPad 3 will be just a little bit thicker than the iPad 2, but that is still a super savvy piece of machinery. The iPad 2 is thinner than an iPhone. The exterior looks are important to many buyers and Google is not known for providing devices that appeal to the lust of the eyes. Voice control is also going to lag behind the Apple iOS system. The Siri digital assistant is in beta, but still beats the Google voice recognition system. It is likely that Google will attempt to baffle the crowds with flashy platform effects. Fighting on the level of operating systems seems to be the order of the day with Google and Apple. Apple is king of the tablets and this Google upstart may be interesting to watch, as the sales wars go live.

Chinese Message Boards Warn Citizens of Stairs that Look Like Escalator; Number of Embarrassed Shoppers Expected to Reach the Hundred Thousands

Every once in a while I come across an escalator that seems out of order. But upon taking my first disappointed step to walk up, the elevator gently shakes to life and carries me triumphantly the rest of the way thinking ?How do they know??

With an increasing effort to conserve energy these escalators are becoming more prevalent and bringing us one step closer to life as seen on The Jetsons.

It?s been said that ?half the joy in life is in the little things taken on the run? like these magical machines. However, the same could also be said about half the agony. A case in point are the steps featured in this photograph that has been circulating around Chinese message boards and drawing the ire of many embarrassed shoppers.

Looking at the picture, it?s understandable how people can mistake this plain flight of stairs for an energy saving escalator. Imagine wandering through the shopping mall with bags in each arm, checking your mobile phone while thinking about what to eat in the food court when you see that familiar black rubber railing. Once you climb onto the step, there is an excruciatingly long second until you realize you?re not moving anywhere. It?s just enough time for anyone in a 10m radius to immediately size you up as mentally challenged.

On the topic of embarrassing situations involving steps, have you ever tried walking up a non-functioning escalator? Even though you can normally manage a staircase like one of those parkour guys, when you have to walk up an escalator that isn?t moving you suddenly feel like a drunk three-year old. This is caused by a combination of our expectation of escalators to move and the phenomenon of ?peripheral drift illusion?. This is where indirectly seeing two strongly contrasting shades (for example, the yellow safety stripes against the black steps) trick our brains into thinking something?s moving when it isn?t. So whenever taking an escalator, be sure to watch your step? then again maybe you shouldn?t.

Mexico says it captures drug-lord security chief

By the CNN Wire Staff

Aide to top drug lord arrested in Mexico

STORY HIGHLIGHTS

  • Alleged drug kingpin's lieutenant handled his security in Durango, Defense Ministry says
  • The arrest will affect Joaquin "El Chapo" Guzman's Sinaloa cartel, official says
  • Guzman is a billionaire who is wanted in Mexico and the United States

(CNN) -- Mexican army special forces have arrested a top lieutenant for alleged drug kingpin Joaquin "El Chapo" Guzman, the Defense Ministry said Monday.

Troops arrested Felipe Cabrera Sarabia on Friday in "a surgical operation in Cuiliacan" in the northwestern state of Sinaloa, said Ricardo Trevilla Trejo, a Defense Ministry spokesman.

Cabrera, who was responsible for the activities of the Pacific Cartel in Durango and the southern part of the state of Chihuahua, was detained after fleeing from Durango, Trevilla told reporters.

"The analysis of his behavior permitted (us) to find the building where he was hiding" and Cabrera was taken into custody without violence, Trevilla said. Firearms, computer equipment and other documentation were seized, too, he said.

Cabrera, who appeared Monday in the office of a prosecutor who specializes in organized crime, was responsible for Guzman's security in Durango, the state-run Notimex news agency said.

He is charged with possessing firearms reserved for use by the army and falsification of a public document, a spokeswoman for the attorney general said.

Trevilla said Cabrera was involved in kidnappings, extortion and arson.

"The violence caused him to rise within the organization," said Trevilla, who predicted that the arrest will affect the cartel's leadership and abilities.

Guzman, who is under indictment by U.S. authorities in Chicago, New York and Los Angeles, is described by the U.S. Drug Enforcement Administration as one of "the most powerful drug traffickers in Mexico." In 2004, the U.S. government announced a $5 million reward for information leading to his arrest and conviction.

He is accused of running a major network that distributes cocaine and heroin.

He is worth about $1 billion, according to Forbes Magazine, which began listing him on its billionaires list in 2009. The magazine lists him as No. 55 on its Most Powerful People list and as the only crime lord on its list of Mexico's billionaires.

The dead were identified in local media as Antoinette Di Palma, 55, and Maria Donata Menchise, 31, and Matthew Menchise, 27.

Their father, Leonardo Menchise, 60, was admitted to a hospital and reportedly had serious wounds.

The suspect, Ettore Bruscella, 77, was immediately taken into custody.

ANSA reports that Bruscella and the Menchise family had a long-running legal feud over the laundromat's chimney.

UK's Prince Philip has heart operation: palace (Reuters)

LONDON (Reuters) ? Britain's Prince Philip, the husband of Queen Elizabeth, had an operation to relieve a blocked artery in his heart on Friday after being rushed to hospital with chest pains, Buckingham Palace said.

"The Duke of Edinburgh was found to have a blocked coronary artery which caused his chest pains," the palace said in a statement. "This was treated successfully by the minimally invasive procedure of coronary stenting."

A stent is a small tube inserted into a blood vessel to keep it open and avoid blockages. The stent is often fitted through a small incision in the chest during keyhole surgery.

Philip, 90, will remain in Papworth Hospital, eastern England, "for a short period," the palace added.

Hollywood dialect coach Robert Easton dies at 81 (AP)

LOS ANGELES ? Character actor and Hollywood dialect coach Robert Easton, whose successes include teaching Forest Whitaker to speak like Idi Amin in the 2006 movie "The Last King of Scotland," has died in Los Angeles. He was 81.

Daughter Heather Woodruff Perry tells the Los Angeles Times ( http://lat.ms/rEfhAQ) that Easton died of natural causes on Monday at his home in the San Fernando Valley.

His movie credits include "Paint Your Wagon," "Pete's Dragon," "Pet Sematary II" and "Primary Colors."

When he was younger, he mainly played country bumpkins on TV shows because of his Southern drawl.

He feared being typecast so he worked on different accents and learned he could mimic regional speech patterns.

As a dialect coach, he worked Arnold Schwarzenegger, Charlton Heston, Liam Neeson, Anne Hathaway and Robert Duvall.

Oops,?housing's crash was worse than thought

Fred Prouser / Reuters

An existing single family home which is up for sale is pictured in Burbank, Calif., Dec. 15, 2011.

By John W. Schoen, Senior Producer

Real estate agents are famous for putting a listing in the best possible light to close a sale. On Thursday, the industry's national trade association confirmed that its monthly data have been painting a rosier picture of the pace of home sales since 2007.

As msnbc.com reported in March, the National Association of Realtors has been overstating the pace of existing home sales by more than 16 percent. The trade group now says just 17.7 million existing homes were sold from 2007 to 2010, not the 20.6 million it originally reported. The NAR made no changes to its data on home prices.

In its announcement of the downward revisions, the trade group sought to downplay the impact of "re-benchmarking" the data lower.

?From a consumer?s perspective, only the local market information matters and there are no changes to local multiple listing service data or local supply-and-demand balance, or to local home prices,? NAR economist Lawrence Yun said in a release explaining the revisions.

The NAR's monthly sales data is a critical input for a host of widely-watched forecasts generated by public and private economists - from Wall Street to the Federal Reserve.?Investors make big bets based on the data. Debates on government?policy, from the White House to Capitol Hill, rely on this barometer of the health of the housing industry, a critical pillar of the U.S economy.

Barclays Capital

The revision shows that home sales were substantially lower than originally reported over the past three years.

But beginning about a year ago, the data reported by the NAR began diverging from the assessment of independent researchers. That began a lengthy reassessment of its data collection methods and analysis as the trade group met with government and private housing experts, including the Federal Reserve, the Department of Housing and Urban Development, the Mortgage Bankers Association, the National Association of Home Builders, government-owned mortgage companies Fannie Mae and Freddie Mac and CoreLogic, a California-based data firm that first raised doubts about the association's data.

It would not be the first time the NAR's economics team has overstated the health of the housing market. Following the housing market peak in late 2005, the trade group's forecasts remained upbeat well into 2007.

Thursday's downward data revisions confirm that the housing market has fallen further than originally thought. But the new numbers don't change the outlook for the market's recovery. That's because the revisions also lowered the NAR's estimate of the number of houses for sale by 18 percent, to 2.6 million from?3.1 million.

"The balance between supply and demand is the same," said Paul Dales, a senior economist at Capital Economics. "The revisions therefore hold no implications for either the previous, or future, path of prices."

The median price for an existing home fell 3.5 percent in November from a year earlier to $164,200, according to the NAR.

On Thursday, the trade group cited a number of factors that combined to skew the data upward. Since the housing market collapsed in 2007, fewer homeowners have opted to sell their house without a real estate agent. At the same time, more homebuilders have begun using the multiple listing services?to find customers. Those shifts?tended to inflate the number of sales captured by those MLS systems, which form the basis for the NAR's data collection.

The expansion of MLS services since 2007 has already created some regional overlap, with more than one MLS system listing the same property in some cases. That overlap lead to some double counting of sales, the NAR said.

The group also cited changes in the way the Census Bureau collects data, population shifts and noted that some sales were counted twice as homes were "flipped" shortly after they were purchased.

The "re-benchmarked" data show the pace of home sales was substantially slower from 2007 through 2010 than originally reported. The figure for 2007 was lowered 11 percent to 5.04 million; 2008 was lowered 16 percent to 4.11 million; 2009 dropped 16 percent to 4.34 million; and 2010 fell by 15 percent to 4.19 million.

The latest monthly data from the group show that existing home sales rose 4 percent in November to a seasonally adjusted annual rate of 4.42 million.

The NAR report follows news Tuesday that home builders are seeing a gradual recovery new housing starts and permits. Last month, builders broke ground on an annual rate of 685,000 homes, according to the Commerce Dept. That was a 9.3 percent jump from October and the fastest pace since April 2010.

The National Association of Realtors announces existing home sales in November increased 4 percent, reports CNBC's Diana Olick.

Netflix CEO's stock options slashed after bad year (AP)

SAN FRANCISCO ? Netflix CEO Reed Hastings will pay a $1.5 million penalty for blunders that alienated the video subscription service's customers and pulverized its stock.

The punishment will be delivered with a 50 percent reduction in his stock option awards next year, according to regulatory documents filed Thursday. Instead of the $3 million stock option allowance he received this year, Hastings will get $1.5 million in 2012. His base salary will remain unchanged at $500,000.

It would have been difficult to make a case for giving Hastings a raise coming off a year in which his decisions transformed Netflix from Wall Street darling to bum. The company's stock price plunged, and subscribers fled in a rebellion against a U.S. price increase of as much as 60 percent. The aftershocks of the subscriber exodus are expected to saddle Netflix with a net loss next year, the first time that has happened in a decade.

Netflix Inc. declined to comment on the changes to Hastings' compensation.

Hastings has repeatedly taken the blame for mismanaging the announcement of the price increase in July and then making things worse two months later by trying to spin off Netflix's DVD-by-mail rental service into a separate website called Qwikster. Since scrapping that idea in October, Hastings has been trying to repair some of the damage.

That will probably take a while. Netflix's stock price has plunged 75 percent since mid-July to wipe out $12 billion in shareholder wealth. The backlash surprised and humbled Hastings, who revealed at an investor conference this month that he once thought Netflix's stock would hit $1,000. Netflix's stock gained $2.87 Thursday to close at $73.84, down from its July high of just under $305.

The stock's downfall elicited some gallows humor from Hastings on his Facebook page. "In Wyoming with 10 investors at a ranch/retreat. I think I might need a food taster," Hastings posted two days after announcing his Qwikster plan.

Hastings' missteps also have cost Netflix at least 800,000 subscribers. That's how many customers Netflix lost during the July-September period. Netflix has said the exodus extended into October and November, though it isn't providing specifics until it reports fourth-quarter earnings next month.

Some analysts have suggested Netflix should consider rescinding at least part of its price increase, but Hastings has brushed aside the notion so far. At the investor conference, he predicted his bad moves will eventually forgotten if Netflix's service for streaming video over high-speed Internet connections keeps growing throughout the world as DVDs slowly fade into obsolescence.

Stocks higher amid upbeat euro outlook

By msnbc.com news services

Wall Street moved higher Friday as investors were attracted to risk assets, with the euro higher and key euro zone bond yields down.

Reflecting improved investor confidence, benchmark Italian bond yields stabilized below 7 percent and Spanish yields also fell. Still, worries persisted over possible sovereign credit downgrades to the euro zone members.

European shares were slightly lower, but mining stocks rose, tracking metals. Copper prices added nearly 2.3 percent.

The euro rose against the U.S. dollar in a rebound from recent losses.

Stocks continued to be supported by strong U.S. data from Thursday, according to Jim Paulsen, chief investment officer at Wells Capital Management in Minneapolis.

"The reality is this morning, (jobless) claims are still way down, manufacturing sectors had a nice pop and that provides a nice floor to the market," he said.

The number of Americans filing new claims for jobless benefits fell to a 3-1/2-year low last week and factory activity in parts of the Northeast picked up in December, data showed Thursday.

Online gamesmaker Zynga Inc was expected to make a strong debut on the Nasdaq Friday after it priced its initial public offering at $10 per share, the top end of its range.

U.S. consumer prices were flat in November as Americans paid less for cars and gasoline, while the 12-month inflation reading fell for the second straight month, which could give the Federal Reserve more room to help a still-weak economy.

Paulsen said that subdued inflation will be a long-term positive as consumers benefit from contained prices.

"That's one of the reasons you're seeing better consumer (confidence) of late," he said.

Research In Motion Ltd posted a sharp drop in profit on Thursday, offered a dismal outlook for BlackBerry shipments during the holidays and delayed an overhaul of its smartphones. The stock dropped nearly 10 percent to $13.64 in premarket trading.

Reuters contributed to this report.

Panetta: Libya needs time to control of militias (AP)

ANKARA, Turkey ? The U.S. needs to give Libya's leaders more time to gain control of the militias that overthrew Moammar Gadhafi before determining how to help the fledgling government, Defense Secretary Leon Panetta said Friday, a day ahead of his historic visit to Tripoli.

While eager to encourage a new democracy that emerged from Libya's Arab spring revolution, the U.S. is wary of appearing as trying to exert too much influence after an eight-month civil war.

At the same time, however, leaders in the U.S. and elsewhere worry about how well the newly formed National Transitional Council can resolve clashes between militia groups in the North African nation.

"The last thing you want to do is to try to impose something on a country that has just gone through what the Libyans have gone through," said Panetta, set to become the first U.S. defense chief to visit Libya.

"They've earned the right to try to determine their future. They've earned the right to try to work their way through the issues that they're going to have to confront," he said.

The continuing violence in Libya, including recent skirmishes between revolutionary fighters and national army troops near Tripoli's airport, reflects the difficulties that Libya's leaders face as they try to forge an army, integrating some of the militias and disarming the rest.

Officials acknowledge that process could take months, and that they can't force the militias to go along.

Panetta told reporters Friday that his visit to the Libyan capital will give him a better sense of the situation, and allow him to pay tribute to the people for bringing down Gadhafi and trying to establish a democratic government.

"It seems to me they are working through some very difficult issues to try to bring that country together," said Panetta. "It's not going to be easy. This is not a country that has a tradition of democratic institutions and representative government. This is going to take some work "

But he said he has seen indications that the Libyans are making progress.

"I think that any country like Libya that was able to do what they did and show the courage that they did in making the changes that took place there ? I'm confident that ultimately they're going to be able to succeed in putting a democracy together," he said.

Panetta said the U.S. is prepared to provide Libya any assistance it needs.

By traveling to Libya, however, Panetta was highlighting the different approaches that the U.S. and other countries are taking with respect to rebellions against tyrannical leaders.

The U.S. and NATO provided months of military power and assistance to the Libyan rebels, but officials have made it clear they do not intend to do the same in Syria despite the furor President Bashar Assad's crackdown on pro-reform demonstrators.

Panetta, who met with Turkish officials Friday, said they did not discuss any specific steps to increase pressure on Assad to step down.

But they talked about the need to work together with other nations to "get Assad to do the right thing."

At some point, he said, he believes that the type of uprisings that happened in Libya and elsewhere across the Middle East will take place in Syria.

Comet defies death, brushes up to sun and lives

WASHINGTON (AP) ? A small comet survived what astronomers figured would be a sure death when it danced uncomfortably close to the broiling sun Thursday night.

Comet Lovejoy was only discovered a couple of weeks ago. It was supposed to melt as it came so close to the sun that the temperatures would hit several million degrees.

But astronomers watching live with NASA telescopes were shocked when a bright spot emerged on the sun's other side. Lovejoy lived.

The comet came within 75,000 miles (121,000 kilometers) of the sun. For a small object often described as a dirty snowball, that brush with the sun should have been fatal.

Astronomers say it probably was not deadly because the comet was larger than they thought.

(AP) ? The Russian billionaire who plans to challenge Vladimir Putin in Russia's presidential election said Thursday that his first move if elected will be to pardon jailed tycoon Mikhail Khodorkovsky.

Mikhail Prokhorov said he would also allow free registration of opposition parties and restore popular elections of provincial governors if he wins March's vote. Putin has marginalized opposition forces, tightened election rules and abolished direct elections of governors.

The 46-year-old Prokhorov, estimated to be worth $18 billion, made his fortune in metals, banking and media. He also owns 80 percent in the New Jersey Nets. Khodorkovsky, once Russia's richest man, has been in jail since 2003 on tax evasion and fraud charges seen as a punishment for defying Putin's power.

Khodorkovsky's lawyers have lost numerous appeals to clear him of the charges.

Prokhorov's surprise announcement this week that he would seek the presidency came in the wake of nationwide protests over alleged fraud in national parliament elections. The protests, which included a throng of tens of thousands in Moscow, were an unprecedented public display of widespread discontent with the man who has dominated Russian politics for a dozen years as president and later as prime minister.

Putin stepped down as president in 2008 because of term limits, but seeks to return to the Kremlin in the March 4 election.

Speaking at a meeting with supporters at a meeting to nominate him for the race, Prokhorov hailed last weekend's protest in Moscow against vote fraud, which attracted tens of thousands in the largest show of discontent in 20 years.

"I deeply understand the demands and the strivings of the people who took to the streets," Prokhorov told reporters, adding that he may join a follow-up protest later this month.

Prokhorov said that "expert opinion" has prompted him to believe that the Dec. 4 parliamentary election was unfair and rigged. But he argued for a legal response to the fraud allegations.

The tycoon avoided criticizing Putin directly, but said he wasn't afraid to challenge his power: "Putin is a serious rival, but I'm not afraid of competition."

Prokhorov, noted for his playboy lifestyle, also humorously noted that he might need to settle down and find a potential first lady.

"I'm ready even for this ? if that's necessary for my country and for winning the presidential election."

Prokhorov's presidential bid follows his botched performance before the parliamentary election when he formed a liberal political party with the Kremlin's tacit support but abandoned it under what he called Kremlin pressure.

Some observers alleged that Prokhorov may have made amends with the Kremlin and might be running for president to accommodate voters unhappy with the authorities to steal the thunder from the opposition.

Prokhorov said in his blog Wednesday that he would play his own game.

"Naturally, my candidacy is good for the Kremlin. Naturally, they want to play democracy and show that people have 'some kind of a choice'," he wrote.

"But we must absolutely use the authorities, too, if we don't want to just make some noise and disappear, but to change our lives for the better."

NASA eyes power in Tropical Storm Washi, warnings in the Philippines

NASA eyes power in Tropical Storm Washi, warnings in the Philippines [ Back to EurekAlert! ] Public release date: 15-Dec-2011

NASA's TRMM satellite measured heavy rainfall and powerful towering thunderstorms as Tropical Depression 27W intensified into Tropical Storm Washi today. Now, warnings are up in areas of the Philippines as Washi heads in that direction.

Now that Tropical Depression 27W strengthened into a tropical storm, it has been given two names: Washi and Sendong. Tropical cyclones within each ocean basin are named in six year lists, but some countries will also assign their own names to a storm, so following a storm can get a little confusing. Low pressure areas that form into a depression are given a number and Washi's was 27W, for the twenty-seventh tropical depression in the western North Pacific this season. Once it strengthens into a tropical storm it gets a name.

Tropical Storm Washi, or Sendong as it is known in the Philippines has residents there on guard as it continues to strengthen upon its approach.

The Philippine Atmospheric, Geophysical and Astronomical Services Administration (PAGASA) Weather Forecasting Section, Weather Division is responsible for forecasts of tropical cyclones affecting the Philippines. PAGASA noted in a bulletin today, December 15 at 5 p.m. local time (0900 UTC or 4 a.m. EST): "Tropical Storm 27W (called "Sendong" in the Philippines) is expected to make landfall over Surigao del Sur early tomorrow (Friday) afternoon and by Saturday afternoon, at 220 km East Northeast of Puerto Princesa City. By Sunday afternoon, it will be at 260 km West Northwest of Puerto Princesa City."

As a result of Washi's (Sendong) approach, PAGASA has posted warning signals. Signal One is in effect for Mindanao and Visayas. Mindanao is the second largest and easternmost island of the Philippines. It is one of the three island groups in the country, the others being Luzon and the Visayas.

Included in the warning in Mindanao is the province of Surigao Del Norte including Siargao Island, Surigao Del, Sur and Dinagat Province, Agusan Provinces and Misamis Oriental. Included in the warning in Visayas are the provinces of Eastern Samar and Western Samar, Leyte Provinces, Camotes Island, and Bohol. Heavy rains and gusty winds are expected. Rainfall may cause flooding and mudslides.

On Dec. 15 at 0900 UTC, Tropical Storm Washi had maximum sustained winds near 35 knots (40 mph/65 kmh). It was about 140 nautical miles (161 miles/259 km) west of Palau near 7.7 North and 131.5 East. It was moving quickly to the west at 20 knots (23 mph/37 kmh).

When the Tropical Rainfall Measuring Mission (TRMM) satellite passed over Washi early today, Dec. 15 at 0205 UTC (Dec. 14 at 9:05 a.m. EST) a "hot towering" thunderstorm was seen in the southwestern quadrant of the storm topping 10 miles (16 kilometers) high. Research done at NASA's Goddard Space Flight Center in Greenbelt, Md. has shown that tropical cyclones are likely to intensify within six hours of a "hot tower" being spotted in a tropical cyclone.

Multispectral satellite imagery showed the banding of thunderstorms wrapping into the center of circulation - another indication that the storm is strengthening. The storm is strengthening because the wind shear is light (only 10 knots/11 mph/18 kmh) and the sea surface temperatures are very warm at about 88 degrees Fahrenheit (31 Celsius) which is about 8F warmer than the minimum temperature needed to maintain a tropical cyclone.

The Joint Typhoon Warning Center expects Washi to make landfall on Friday, Dec. 16 and then re-emerge over water in the Sulu Sea. In the meantime, residents of Minandao and Visayas need to prepare for Washi's arrival.

Italian appeals court says why it cleared Knox (AP)

MILAN, Italy ? The Italian appeals court that overturned Amanda Knox's murder conviction in the slaying of her British roommate gave the reasons for its ruling on Thursday: the evidence that had been used by a lower court against the American and her Italian boyfriend just didn't hold up.

Those shortcomings included no murder weapon, faulty DNA, an inaccurate time for the killing, and insufficient proof that Knox and Raffaele Sollecito were even at the location where the crime occurred. So said the Perugia appellate court in its long-awaited reasoning behind its October ruling that reversed the lower court's convictions.

British college student Meredith Kercher was found slain in a pool of blood on her bedroom floor in Perugia, Italy, on Nov. 2, 2007.

Knox and Sollecito, who had just begun dating at the time of the murder, were arrested several days later, then convicted in what prosecutors' portrayed as a drug-fueled sexual assault. They were sentenced to 26 years and 25 years, respectively, in proceedings that made headlines around the world.

On Thursday, the appellate cited among the other failed elements of the prosecutors' case DNA evidence, which was undermined during a re-examination in the appeals trial, and the failure to conclusively identify the murder weapon. The appellate court even contradicted the lower court's time of death, saying it happened at around 10:15 p.m., not after 11 p.m. The court said the "building blocks" used to construct the case had failed.

The appeals court also said there was no proof of the prosecutors' claim that Knox and Sollecito had helped a third man, who was convicted separately, of sexually assault Kercher, nor was there evidence that the pair had simulated a burglary by throwing a rock through a window to remove suspicion from themselves, as prosecutors alleged.

The appeals court said the lower court had arrived at a verdict "that was not corroborated by any objective element of evidence and in itself was not, in fact probable: the sudden choice of two young people, good and open to other people, to do evil for evil's sake, just like that, without another reason."

"It is not, therefore, sufficient that the probability of the prosecutors' hypothesis is greater than the hypothesis of the defense, not even when they are notably greater in number, but it is necessary that every explanation that differs from the prosecutors' hypothesis is, according to the criteria of reasonability, not at all plausible," the court said.

The only elements of the prosecutors case that were proven, the appeals court said, were the charge of slander against Knox, who was convicted of falsely accusing a bar owner of killing Kercher, and the fact that the Knox and Sollecito alibis did not match.

That the alibis were out of synch "is very different" from the prosecutors' claim of false alibis, the court said.

The proven elements combined, the court said, are not enough to support convictions against Knox and Sollecito.

"The only elements that are sustained don't allow the belief, even when put together, that the guilt of Amanda Knox and Raffaele Sollecito for the crime of murder ... has been proven," the court said.

After her conviction was thrown out, Knox, 24, returned immediately home to Seattle. She was credited with time served for the conviction of slander for accusing bar owner Diya "Patrick" Lumumba of carrying out the killing.

Prosecutors contended a kitchen knife found at Sollecito's house was the weapon because it matched wounds on Kercher's body and carried traces of Kercher's DNA on the blade and Knox's on the handle. However, the court-ordered review discredited the DNA evidence, saying there were glaring errors in evidence-collecting and that below-standard testing and possible contamination raised doubts over the DNA traces on the blade and on Kercher's bra clasp.

In addition, the defense cast doubt on the knife, questioning why Knox and Sollecito would return it to Sollecito's home if it had been used in the murder. They maintain the real weapon has yet to be found.

A third defendant in the case, Rudy Hermann Guede of the Ivory Coast, was convicted in a separate trial of sexually assaulting and stabbing Kercher. His 16-year prison sentence ? reduced on appeal from an initial 30 years ? was upheld by Italy's highest court in 2010.

The appeals court also expressed incredulity that the two would have cooperated in such a crime with Guede, with whom there is no proof of any relationship. "For example, there is no evidence of phone calls or text messages between the three," the court said.
